Terms of Service

1. Acceptance of Terms

By accessing or using ShaadiShots ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ShaadiShots is a desktop application for wedding and event photographers. It uses AI face recognition to automatically organize and group event photos into personalized galleries for each guest, which guests access by scanning a QR code. The application is installed and runs on your own computer. The Software is provided by KumawatPulse Technologies Pvt Ltd.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Self-Hosted Application & Data

ShaadiShots runs entirely on your own computer. Your photos, face-recognition data, and guest information are processed and stored locally and never uploaded to our servers. You are solely responsible for your own data, including obtaining any consent required to process the faces of guests captured at your events.

The one exception is license validation: when the application starts, it contacts our license server to validate your license key or free trial. This validation transmits your license key, a hashed device and installation identifier, the application version, and the time of validation. This data is used only to operate the licensing service and enforce license terms.

Data we store. To operate the Service we collect and store certain account, order, and licensing records in our database — for example, your customer identifier, email address (if you provide it), billing country, payment order details (order reference, amount, currency, status), hashed device and IP identifiers, trial records, and license keys (stored encrypted). We never store your full card number. Card payments are processed directly by Razorpay or PayPal. By using the Service, you acknowledge and consent to this collection, processing, and storage, as described in our Privacy Policy.

5. Payments & No Refund Policy

All payments are final and non-refundable. Before making any payment, you will receive a live demo of ShaadiShots so you can evaluate the product fully. By proceeding with payment, you confirm that you have seen and accepted the demo. No refunds will be issued after payment is completed.

6. Content Ownership

You retain full ownership of all photos and media processed by ShaadiShots. Since the application runs on your own system, your content never leaves your control. We claim no intellectual property rights over your content.

7. Intellectual Property

The ShaadiShots software, design, branding, and documentation are the intellectual property of KumawatPulse Technologies Pvt Ltd. You may not copy, modify, distribute, or reverse-engineer the software beyond what is permitted by applicable law.

8. Distribution & Activation

ShaadiShots is distributed as a downloadable desktop application for Windows, macOS, and Linux. After installation, the application must be activated with a valid license key or a free 7-day trial. You are responsible for your own hardware, operating system, and data security.

9. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service
• Use the Service to process content that violates applicable laws
• Resell or redistribute the Service without written authorization

10. Limitation of Liability

To the maximum extent permitted by law, ShaadiShots and KumawatPulse Technologies Pvt Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to data loss, service interruption, or unauthorized access.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless KumawatPulse Technologies Pvt Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Jaipur, Rajasthan, India. The language of arbitration shall be English.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.

15. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
